These Terms and Conditions ("Terms") govern your use of the Mindryze mobile apps and website (together, "Mindryze" or the "Service"). Please read them carefully. By creating an account, or by continuing to use Mindryze, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Mindryze.
## 1. Who we are
Mindryze is operated by Venkat Sai Chikkam, an individual based in India ("we", "us", "our"). You can contact us at support@mindryze.app.
## 2. Who can use Mindryze
You must be at least 13 years of age to create an account or use Mindryze. By agreeing to these Terms, you confirm that you are.
If you are under 18, please review these Terms and our Privacy Policy with a parent or guardian, and use Mindryze only with their permission.
If you are a parent or guardian and believe a child under 13 has created an account, please contact us at support@mindryze.app and we will delete it.
## 3. Your account
3.1 You can sign in with an email address and password, with your phone number, or with Google or Apple, depending on what is available on your device.
3.2 You agree to give accurate information, to keep your password and sign-in methods secure, and to tell us promptly if you believe someone else has accessed your account. You are responsible for activity on your account that results from your failure to keep it secure.
3.3 Each account is for one person. You may not sell, transfer or share your account.
3.4 We may ask you to confirm your email address before you can use your account.
## 4. What Mindryze is, and what it is not
4.1 Mindryze is a collection of puzzle and brain-training games provided for entertainment and practice.
4.2 Mindryze is not a medical product. It is not designed to diagnose, treat, cure or prevent any medical, psychological or cognitive condition, and it is not a substitute for advice from a qualified professional. We do not promise that playing Mindryze will improve your memory, attention, intelligence or any other ability, or that any improvement in the games will carry over to other activities.
4.3 Scores, stars, levels, statistics and similar figures in Mindryze describe your performance in our games only. They are not tests or assessments of your abilities.
4.4 AI Personalized mode adjusts the difficulty of the games automatically, based on how you have played before. It is an automated system that runs within Mindryze. It does not involve a person reviewing your play, it does not use outside AI services, and its choices may not always suit you.
## 5. Free and paid features
5.1 You can create an account and play Mindryze's games in Normal mode free of charge. Some features, such as AI Personalized mode, may be offered only for a fee ("Paid Features"). We will make clear in the app which features are Paid Features, and what they cost, before you buy.
5.2 Before you pay. The price, what it includes, and whether it is a one-time purchase or a subscription will be shown to you before you buy. Prices include any taxes the store is required to show. Nothing is charged without your confirmation.
5.3 How you pay. Purchases in the Android and iPhone apps are made through Google Play or Apple's App Store, using the payment method in your store account. Their terms and payment policies also apply to your purchase. We do not receive or store your card or bank details.
5.4 Subscriptions. If a Paid Feature is offered as a subscription, it renews automatically at the end of each billing period, at the price then in effect, until you cancel. You can cancel at any time in your Google Play or App Store account settings; cancelling stops future renewals, and you keep access until the end of the period you have already paid for. If a free trial is offered, you will be charged when it ends unless you cancel before then, as the store will explain at the time.
5.5 Price changes. We may change the price of Paid Features. A new price will not apply to a period you have already paid for. For subscriptions, we will give you notice before a higher price applies, as required by Google Play or the App Store, and you can cancel before it takes effect.
5.6 Refunds. Refunds for purchases made through Google Play or the App Store are handled by them, under their refund policies. Except where the law requires otherwise, or where Google or Apple grants a refund, payments are non-refundable, including for partly used subscription periods. Nothing in this section affects any right to a refund you have under applicable law.
5.7 Your purchase and your account. Paid Features are linked to your Mindryze account and, where applicable, your store account. They are for your personal use and cannot be transferred. If you delete your account, you lose access to Paid Features; deleting your account does not cancel a subscription in the store, so please cancel it there as well. If we close your account under section 12.2 because you broke these Terms, you will not be entitled to a refund for the remaining period, except where the law requires otherwise.
5.8 If we change or stop a Paid Feature. If we stop offering a Paid Feature you have paid for, or change it so that it no longer provides its main benefit, before the end of a period you have paid for, we will either provide a reasonable substitute or arrange a refund for the unused part of that period, where we are able to do so through the store, or as the law requires.
## 6. Acceptable use
When using Mindryze, you agree not to:
- cheat, or manipulate scores, levels or other results, including through modified versions of the app, automated tools, scripts or bots;
- copy, modify, decompile, reverse engineer or attempt to extract the source code of Mindryze, except to the extent the law allows you to do so despite this restriction;
- interfere with, disrupt or try to gain unauthorised access to Mindryze, its servers or other players' accounts;
- use a display name that is offensive, misleading, or impersonates someone else;
- collect data from Mindryze by automated means;
- use Mindryze for any unlawful purpose, or in any way that breaks these Terms.
## 7. Fair play
Mindryze checks game results for signs of tampering. We may disregard, correct or remove results that appear to have been manipulated, and we may take the steps described in section 12 if we reasonably believe you have broken section 6.
## 8. Your content
The only content you can add to Mindryze is your display name. You keep any rights you have in it, and you allow us to store and show it within Mindryze to operate the Service. You must not use a name you do not have the right to use.
## 9. Our content and intellectual property
9.1 Mindryze, including its games, design, text, graphics, code, name and logo, is owned by us or by our licensors and is protected by intellectual property laws.
9.2 Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable licence to use Mindryze, including any Paid Features you have bought, for your own non-commercial purposes. We keep all rights not expressly given to you.
9.3 Some parts of Mindryze are provided by third parties under their own licences, which apply to those parts. These include word definitions from WordNet 3.0 (Copyright 2006 by Princeton University) and the Nunito and Baloo 2 typefaces (SIL Open Font License 1.1).
## 10. Privacy
Our Privacy Policy explains what information we collect, how we use it, and the choices and rights you have. It forms part of these Terms.
## 11. Changes to Mindryze and availability
11.1 We are continually improving Mindryze. We may add, change or remove games, features or content, and we may change how levels, scores and difficulty work.
11.2 We aim to keep Mindryze available, but we do not guarantee that it will always be available, uninterrupted or free of errors. It may be unavailable at times, for example for maintenance, because of technical problems, or for reasons outside our control.
11.3 We may stop providing Mindryze, in whole or in part. Where we reasonably can, we will give notice of significant changes or of the Service ending.
## 12. Suspension and termination
12.1 You can stop using Mindryze at any time, and you can delete your account in the app under Settings > Delete account, or by emailing support@mindryze.app. After you ask to delete your account, it is kept for 3 days in case you change your mind; signing in during that time lets you keep it. After that, your account and the game data stored with it are permanently deleted, as described in our Privacy Policy.
12.2 We may suspend or close your account, or limit your access to Mindryze, if we reasonably believe that you have broken these Terms, that your use creates a risk for us or for other players, or that we are required to do so by law. Where appropriate, we will tell you the reason, unless doing so would be unlawful or would compromise security or an investigation.
12.3 When your account is closed, your licence to use Mindryze ends. Sections 5.6, 5.7, 9, 13, 14, 15, 19 and 20 continue to apply.
## 13. Disclaimer
To the fullest extent permitted by law, Mindryze is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of fitness for a particular purpose, accuracy or non-infringement. Nothing in these Terms excludes or limits any rights you have under applicable law that cannot be excluded or limited, including your rights as a consumer under Indian law.
## 14. Limitation of liability
14.1 To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or for any loss of data, game progress, scores, opportunity or goodwill, arising out of or relating to your use of, or inability to use, Mindryze.
14.2 To the fullest extent permitted by law, our total liability to you for all claims arising out of or relating to Mindryze or these Terms is limited to the greater of (a) the total amount you paid for Paid Features in the 12 months before the claim arose, and (b) INR 1,000.
14.3 Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, such as liability for fraud.
## 15. Indemnity
To the extent permitted by law, you agree to compensate us for any claims, losses and reasonable costs (including reasonable legal fees) that arise from your breach of these Terms or your misuse of Mindryze.
## 16. Third-party services
Mindryze relies on services provided by others, including Google Firebase (which stores account and game data), sign-in with Google and Apple, and the Google Play Store and Apple App Store (through which the apps are distributed and Paid Features are bought). Your use of those services may also be subject to their own terms and policies. We are not responsible for services we do not control.
## 17. If you downloaded Mindryze from Apple's App Store
These Terms are between you and us, not Apple. Apple is not responsible for Mindryze or its content, and has no obligation to provide maintenance or support for it. To the extent any warranty applies, Apple has no warranty obligation for Mindryze; any claims relating to Mindryze, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and intellectual property claims, are our responsibility and not Apple's, to the extent required by these Terms and the law. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
## 18. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to Mindryze or to the law. We will post the updated Terms with a new effective date. If the changes are significant, we will let you know in the app or on our website, and we may ask you to agree to them again. If you continue to use Mindryze after the updated Terms take effect, you accept them. If you do not agree, please stop using Mindryze and delete your account.
## 19. Governing law and disputes
19.1 These Terms are governed by the laws of India.
19.2 If you have a concern, please contact us first at support@mindryze.app so we can try to resolve it informally. If we cannot resolve it within 30 days, either of us may take the matter to the courts at [CITY, STATE], India, which will have jurisdiction, without affecting any right you have under applicable consumer law to bring a claim where you live.
## 20. General
20.1 These Terms, together with the Privacy Policy, are the entire agreement between you and us about Mindryze.
20.2 If any part of these Terms is found to be invalid or unenforceable, the rest will remain in effect.
20.3 If we do not enforce a right under these Terms straight away, we have not given it up.
20.4 You may not transfer your rights under these Terms. We may transfer ours, for example if Mindryze is transferred to a company we set up or to a new owner, as long as your rights under these Terms are not reduced.
20.5 We are not responsible for delays or failures caused by events beyond our reasonable control.
20.6 These Terms are written in English. If they are translated, the English version applies.
